Riley Earle has been an employee of Coutts Solicitors and Conveyancers since October 2017. Riley is currently working in our Family Law, Criminal Law and Dispute Resolution teams in both the Sydney and Narellan offices. Riley holds a Bachelor of Laws/Bachelor of Business and Commerce from the University of Western Sydney.

During her time studying at Western Sydney University, Riley was a part of the Academy, a High Achieving Student Program which focused upon establishing community engagement and personal and professional development. Riley was awarded the Robyn Ashes Award for Most Outstanding Student in Family Law and the Gilbert & Tobin Award for Most Outstanding Student in Law of Associations. Riley is a member of the Golden Key International Honour Society, an invitation only society for the top 15% of University students.

Riley assists the Coutts Legal team in a variety of practice areas including but not limited to the Commercial Litigation department, Family Law, Wills and Estates and Local Government, Environment and Planning matters.

Riley has been involved in various matters including:

  • Drafting Deeds of Settlement and Release to finally and fully resolve disputes in commercial matters, taking into account concepts such as full releases, confidentiality and non-disparagement of parties after settlement;
  • Preparing and filing Unfair Dismissal Applications for employees to initiate proceedings in the Fair Work Commission and assisting with the preparation of the Employer Response to the Unfair Dismissal Application in separate matters;
  • Preparing an Unfair Dismissal Matter for telephone conciliation conferences in the Fair Work Commission and being in attendance at the conciliation conference;
  • Preparing letters of advice in relation to entitlements of a variety of employees under Australian awards such as the General Retail Industry Award and preparing advice based upon entitlements conferred in Awards and in the National Employment Standards embodied in legislation;
  • Drafting Statement of Claims for the Local Court of New South Wales in the Chief Industrial Magistrates Court to recover outstanding unpaid entitlements of employees under the Local Court Small Claims Division;
  • Preparing comprehensive letter of demands requesting payment of outstanding unpaid entitlements such as minimum wage issues, holiday payment and sick leave of employees in a variety of industries;
  • Preparation of letters to cease and desist from acting in defamatory matters for individual and business clients to preserve their reputation amongst their community and greater business market;
  • Drafting letters on behalf of businesses who wish for unfair, damaging and unsatisfactory reviews to be removed from public view on websites such as Google and advisory websites;
  • Researching and drafting the response for removal of content defaming an individual on a Google Business Page; 
  • Preparation of response to a Developers rescission of a contract under section 66ZL of the Conveyancing Act, in which a client would have been financially detrimentally affected by rescission of a contract due to the Vendor’s inability to obtain development consent of Council and preparing an offer of settlement to obtain purchaser consent to rescission;
  • Liaising with and preparing extensive research documents for Barristers within the Sydney CBD region in relation to class four proceedings in the Land and Environment Court. This included research on the Fair Trading Act 1987 and the former Trade Practices Act 1974, to provide clarity in relation to limitation issues, issues pertaining to the necessary parties to proceedings and abuse of process in relation to Directors Duties;
  • Extensive research on misleading and deceptive conduct as defined in the Competition and Consumer Act 2010;
  • Preparing comprehensive briefs for Barristers to obtain advice in relation to matters both in private disputes, New South Wales Courts and the NSW Civil and Administrative Tribunal;
  • Preparing lengthy letters of advice to clients identifying imperative clauses within lease agreements and identifying obligations on parties upon the signing of lease agreements for properties in New South Wales and Queensland;
  • Drafting both standard and complex Wills, Powers of Attorney and Enduring Guardianships for a range of clientele;
  • Assisting the Coutts team in relation to advising clients on general litigation disputes;
  • Preparing an extensively detailed Application to initiate proceedings of a Building Dispute in the NSW Civil and Administrative Tribunal and the following witness statements for disputes in the Building and Commercial Division of NCAT;
  • Preparation of numerous Writs for the Levy of Property to enforce debts owing for unpaid rates for a Council client and debts owed under private written agreements in proceedings before the Local Court of New South Wales and the District Court of New South Wales. Once Writs were obtained, then attending to filing documentation with the Land Registry Services to ensure that Writs are enforceable on title of any property owned by Judgment Debtors, to best enforce the judgment debt for Judgment Creditor clients;
  • Taking instructions from clients in relation to Family law matters involving property settlements and children;
  • Drafting Initiating Applications and Notice of Risk in family law matters;
  • Drafting Application for Consent Orders, Proposed Orders by Consent and Affidavit of Waivers; and
  • Drafting criminal representations.
